(S.D.)-State Supreme Court To Review Vehicular Homicide Case

     PIERRE, S.D. (ASSOCIATED PRESS) - South Dakota Attorney General Marty Jackley says his office will appeal to the state Supreme Court a judge's decision to grant a new trial to a Belle Fourche man serving 25 years for a fatal accident conviction.
     Oakley Engesser was convicted of vehicular homicide and vehicular battery for the 2000 accident on Interstate 90 near Sturgis that killed his friend Dorothy Finley of Rapid City.
     Jackley says it's the state's position that the evidence presented at trial supported Engesser's conviction.
     Judge Warren Johnson recently overturned Engesser's conviction and ordered a new trial.
     Engesser lost earlier appeals, but a federal judge threw out his conviction in 2011 and he was released from prison. Then an appeals court reinstated it last year.
