(SD)-Not Guilty Plea In Murder Of Prison Escapee In Edgemont
RAPID CITY, S.D. (AP) - A South Dakota prison inmate charged with killing another inmate near Edgemont while both were free in January has pleaded Not Guilty.
27-year old Thomas Lucero of Sioux Falls is charged with alternative counts of 1st-degree and 2nd-degree murder for the death of 32-year old Moses Dubray.
He's also charged with aggravated assault with a firearm against a person identified in the indictment as a confidential informant who testified before the grand jury.
Lucero was free on parole when Dubray, serving a 5-year sentence for burglary walked away from the minimum security prison in Rapid City in January.
Dubray's body was found January 11th a quarter-mile off Highway 89 on Wild Sage Road in Edgemont with an autopsy showing he died from a gunshot wound to the head.
Authorities began seeking Lucero after an arrest warrant was issued for parole violation and he turned himself later in January
Although the charges are filed in Fall River County, Assistant Attorney General Gina Nelson is the prosecutor while Paul Eisenbraun is representing Lucero...whose next court appearance is set for Jan 11...exactly a year after Dubray's body was found..
