(SD)-Resentencing For Ex-State's Attorney Brings Probation

RAPID CITY, S.D. (AP) - A former Bennett County South Dakota State's Attorney convicted of tax evasion won't be doing any jail time after all, only 5 years of probation.

      U.S. District Judge Jeffrey Viken originally sentenced 48-year old Ken Orrock to 12 months in prison to be served on weekends over 3-1/2 years so Orrock could maintain his business, pay back the IRS, and help care for his special-needs son, but discovered federal prison rules limit intermittent confinement to one year.

      Orrock had accepted a plea bargain in the case after being charged with willful failure to collect and pay employee taxes in 2015 as owner of the Black Hills Patrol security company.
