(Neb.)-Lawmakers Consider Health-Insurance Plan

By: Chad Franzen Posted at: 02/03/2010 03:17 PM

LINCOLN, Neb. (AP) - Nebraska residents are debating whether the state should try to reject health-insurance mandates, even though doing so probably wouldn't stop the federal government from forcing coverage.

On Wednesday, supporters and opponents of a proposed amendment (LR289CA) to the Nebraska Constitution testified before a legislative committee.

Sen. Beau McCoy of Omaha's proposal would bar the state from forcing people to buy insurance or fine people for not obtaining insurance. Congress has considered assessing penalties against people who don't obtain health insurance.

If Congress passes such a measure, it could be imposed even if Nebraska did pass the constitutional amendment.

But McCoy has said it could help set up a court challenge of such a federal law.
